These terms and conditions are valid for the purchase of the goods on the internet on www.schulzdiabolo.cz, run by JSB Match Diabolo a.s. The terms and conditions more closely limit and specify the rights and duties of the JSB Match Diabolo a.s. (further only as vendor) and the consumer (“consumer” is a subject which has entered into an agreement about goods purchase with the vendor).
All order placement passed through email or telephone are binding. By order placement the consumer confirms that he/she have read and understand these terms and conditions, including the complaint procedure, and agrees with them. The consumer places his/her name, address, telephone number, email, required amount and the type of goods on the order placement.
The order placement is a proposal of a purchase agreement. The purchase agreement ensues with the moment of ordered goods acceptance by the consumer. The condition under which the order is valid is that the consumer provides the vendor with all specified details.
The place of delivery is the address stated by the consumer during individual order placement.
The consumer gets the ownership rights after he/she has paid for the ordered products in full.
By providing the data the consumer agrees with the vendor’s collecting and archiving personal data about the consumer and his/her orders.
The vendor has the right to refuse an order if the consumer has not repeatedly carried out their obligations in terms of goods withdrawal and payment.
The vendor has the right to withdraw from the contract (binding agreement) if the performance becomes impossible and the consumer does not agree with a new contract performance.
The consumer is obliged to accept the ordered goods and to pay for it in full, including possible delivery charges. The consumer is given the total price during the order completion and before agreeing with the binding agreement.
The vendor has the right to cancel the order or parts of the order in the following cases:
The vendor has the right to change the prices. Valid prices are confirmed by the consumer at the moment of binding agreement confirmation. If the valid price is identical or lower than in the written, faxed or electronic order, the consumer does not receive a confirmation of an order and the order is delivered to the consumer for the price that was valid at the moment of order acceptance. If the price is any higher than the price stated on an order the vendor is obligated to inform the consumer about this fact without delay. The consumer then has the right to either accept the new price, or cancel the order. During the telephone order the consumer is always told the valid price for a given order.
The consumer, if they are general public and not enterprising companies, has the right to withdraw from the contract in all cases stated by Czech law no. 40/1964 collection of the Civil Code, subsequently amended. The withdrawal is valid from the moment the vendor has received consumer’s written statement about contract withdrawal. In the case of contract withdrawal the contract is cancelled and the contracting parties are obligated to return any monies or goods paid or received until the moment of cancellation.
The consumer must return the vendor everything he/she received from the vendor based on the binding agreement. If it is not possible because of damage caused to the goods, depletion of the goods or some parts of goods, the consumer is obligated to provide financial compensation to the vendor. In this case the vendor returns the consumer the purchase price lowered by the given financial compensation.
The consumer has no rights to withdraw from the contract, unless stated otherwise, and further with accordance to the contract agreements modified according to the consumer, or previously specified goods modification for the consumer’s needs.
- Delivery date
The ordered goods are delivered in the shortest period possible, dependant on the vendor’s availability and operating facilities. The usual delivery date is seven working days from the binding agreement confirmation, the consumer will be informed in the case of any possible delay. All products are considered delivered at the moment of delivery at consumer’s order stated address.
- Delivery terms and conditions
The place of delivery is the address that the consumer stated on the placement order (unless stated otherwise in the note section). All goods are sent through Česká pošta, or the consumers can collect them personally.
There is an invoice enclosed in each delivery that also serves as a bill of delivery.
1. – payment cash on delivery:
You will pay the delivery attendant when accepting the delivery together with the delivery charge, which is in accordance with Česká Pošta’s valid tariffs. In the case of overseas shipment we require payment first.
2. In cash – goods collection in person
After previous agreement the goods can be collected in person from our premises Monday to Friday between 7am and 2pm. In this case you will be required to pay in cash.
These terms and conditions are valid in a word of vendor’s internet sites (www.schulzdiabolo.cz) on the day of consumer’s electronic order placement.
By placing an electronic order placement the consumer agrees with the terms and conditions valid on the day of order placement, together with the price of products valid on the day of order placement (including the delivery and postal charge) stated on the internet sites, unless agreed otherwise in a provable agreement. The sent order (the purchase agreement proposal) is binding.
The parties have agreed according to the terms and conditions of the Commercial Code, §262 paragraph 1, that unless the terms and conditions are stated otherwise, their rights and obligations follow the Commercial Code.
